'Wish' Hmmm show me one study that shows actual impact of smokers killing people second hand, not an estimate, but an actual study. I'll be waiting, but not holding my breath. I don't smoke but I believe in the owners right to decide how to run their property. Owners choice sure, state mandate no thank you.

To respond to the last poster's comment, I think that Jacob was happy to see a restaurant go smoke-free voluntarily. Most have due to customer preferences and therefore people who hate smoke can easily avoid being around smoke.

The problem is when the state makes every single establishment ban smoking. That is a violation of the freedom of private enterprise and the freedom to associate with those of a common ilk. My dislike of smoke in restaurants does not entitle me to ban smoke in restaurants just because I don't like it. I don't like NASCAR so I don't attend their races; I do not seek to ban them.

Attending a restaurant is a purely dicretionary activity that no one is forced to do. Ergo restaurants should be able to decide how they operate and serve their customers.
